Welcome to Vulncure. These Terms and Conditions govern your use of our website and services (collectively, the "Services") and form a binding legal agreement between you ("you," "your") and Vulncure ("we," "our," or "us").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use our Services.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services following the posting of revised Terms and Conditions means that you accept and agree to the changes.

Use of Services

Account Registration

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

Service Limitations

Our security assessment and penetration testing services are provided for legitimate security improvement purposes only. You agree to use our Services only on systems, networks, and applications that you own or have explicit permission to test.

You must not use our Services to:

Engage in any unlawful activity
Violate any third-party rights
Attempt to gain unauthorized access to any systems or data
Disrupt or impair the functionality of any system or network
Test systems without proper authorization
Share, distribute, or use testing results for malicious purposes

Service Availability

We strive to ensure that our Services are available at all times. However, we do not guarantee uninterrupted access to our Services and may suspend, withdraw, or restrict the availability of all or any part of our Services for business and operational reasons.

Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Vulncure, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal and business purposes. This license does not include:

Modifying or copying our materials
Using any material for commercial purposes
Attempting to decompile or reverse engineer any software contained in our Services
Removing any copyright or other proprietary notations
Transferring the materials to another person or "mirroring" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

Confidentiality and Reports

We understand the sensitive nature of security assessments and penetration testing. All information regarding your systems, vulnerabilities, and testing results will be treated as confidential.

You retain ownership of all data and information you provide to us. However, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such data as necessary to provide the Services and as specified in our Privacy Policy.

Security assessment reports and deliverables provided through our Services are for your internal use only. You may not publish, distribute, or share these reports with third parties without our prior written consent, except as required by applicable laws or regulations.

All assessment findings, reports, and recommendations are delivered through our secure dashboard. Your data and security information remain confidential and are never shared with third parties.

Limitations of Liability

To the fullest extent permitted by law, Vulncure shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Services
Any conduct or content of any third party on the Services
Any content obtained from the Services
Unauthorized access, use, or alteration of your transmissions or content

Our liability shall be limited to the maximum extent permitted by law, and in no event shall our aggregate liability exceed the amount paid by you, if any, for accessing our Services during the twelve months preceding your claim.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms and Conditions shall be resolved through amicable negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall take place in New Delhi, India, and the language of arbitration shall be English.

Indemnification

You agree to defend, indemnify, and hold harmless Vulncure, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms and Conditions
Your use of the Services, including any use of the Services that is not as expressly authorized
Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right

Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.

Waiver

No waiver by Vulncure of any term or condition set out in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by Vulncure to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

Cancellation and Refund Policy

We understand that business needs and priorities may change. Our cancellation and refund policy is designed to be fair and transparent.

Before Testing Begins

If you need to cancel a scheduled security assessment or penetration test before the testing phase has begun, you may be eligible for a refund. Please contact Vulncure directly to discuss your specific situation and refund options.

Refunds are only available for services that have not yet commenced the active testing phase. Once a penetration test or security assessment has begun, no refunds will be provided.

After Testing Begins

Due to the nature of security testing services and the resources allocated to your project, we are unable to offer refunds once the testing phase has commenced. This includes any preliminary reconnaissance, scanning, or active testing activities.

Rescheduling

If you need to reschedule a planned security assessment, please contact us as soon as possible. We will make reasonable efforts to accommodate your request, subject to our availability and resource commitments.
